Terms of Use

Basketball is a physical contact sport. Taking part carries a real risk of injury, including serious injury. By creating an account and taking part in KBC games you accept that risk and agree to take responsibility for your own health, fitness and safety.

1. Who these terms are between

These terms are between you and Kallo Ballers Club (โ€œthe clubโ€), which organises the games. The app itself is provided by CasualKiosk, which supplies the software only and does not organise, supervise or take part in any game.

By creating an account you agree to these terms. If you do not agree, do not create an account.

2. Your account

You must give accurate details, keep your password secure, and not let anyone else use your account. Tell an admin promptly if you think someone else has accessed it.

Accounts are approved by a club admin before you can register for games. The club may decline, suspend or close an account at its discretion, for example for unpaid fees or unsafe or abusive behaviour.

You must be at least 16, or have a parent or guardian's consent.

3. Games, registration and payment

Registering for a game does not guarantee a place. Places are limited and, where a game is full, a place is only secured once payment is received. If you have not paid, your place may be given to someone on the reserve list who has.

Fees are set by the club and shown before you register. Refunds are at the club's discretion, except where you are entitled to one under the Australian Consumer Law.

The club may change, postpone or cancel a game, for example if a venue becomes unavailable or too few players register.

4. Taking part, and your own safety

You take part voluntarily and at your own risk. You confirm you are medically fit to play, and you are responsible for deciding whether to play on any given day.

Games are casual and are not necessarily supervised by qualified first-aid officers, referees or coaches. You are responsible for your own health insurance, ambulance cover and any personal accident insurance you want.

You must play safely and fairly, follow venue rules and reasonable directions from admins, and treat other players with respect.

5. Liability

To the maximum extent permitted by law, neither the club, its admins and volunteers, nor CasualKiosk, is liable for any loss, damage, injury or expense arising from your use of this app, your participation in games, or the conduct of other players, including where caused by negligence.

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded. Where liability can be limited rather than excluded, it is limited to resupplying the relevant service or paying the cost of doing so.

The app is provided on an โ€œas isโ€ basis. CasualKiosk does not warrant it will be uninterrupted or error free, and is not responsible for the club's decisions about who plays, what is charged or how games are run.

6. Your personal information

The club collects your name, email address, and, if you provide them, your photo and playing position, along with your registrations, attendance and payment records. This is used to run games, manage teams and keep track of fees.

Your name and photo are visible to club admins and, where you are named in a game line-up, to other players present, including on screens shown at the venue. Your email address and payment records are visible only to club admins.

Information is handled in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. You can ask an admin to see, correct or delete your information, or to remove your photo, at any time. Payment card details are handled by our payment provider and are never stored by the club or CasualKiosk.

7. Photos taken at games

Photos you upload are used to identify you in line-ups and on venue screens. Ask an admin if you would prefer your photo not to be displayed.

8. Changes to these terms

The club may update these terms. If they change materially you will be asked to accept the new version before continuing to use the app. Continuing to take part after a change means you accept it.

9. Governing law

These terms are governed by the laws of Victoria, Australia, and you submit to the courts of that state.
